Professor Wang Zhixiang's Co-Authored Book Research on the Crime of Dangerous Driving under the Influence Published in the Beijing Law Library Series by Law Press

In July 2024, the monograph “Research on the Crime of Dangerous Driving under the Influence,” co-authored by Professor Wang Zhixiang from the Law School of BNU, was included in the “Beijing Law Library” series and published by the Law Press. This book draws on the interim findings of the National Social Science Fund project “Research on the Relationship between Formal Rationality and Substantive Rationality in Criminal Law” (Project No. 21BFX009), for which Professor Wang serves as principal investigator

Since the Standing Committee of the National People’s Congress promulgated the “Criminal Law Amendment (VIII)” in 2011, which criminalized drunk driving, the number of such cases has increased steadily, exceeding 300,000 in 2019. This made it the most prevalent criminal offense that year, elevating the crime of dangerous driving under the influence to a position of significant prominence. Both the legislative approach of treating it as an abstract endangerment crime and the judicial policy of “universal criminalization” have made it a crucial focal point for academic research on the expanding trend of the criminal circle. On December 18, 2023, the Supreme People’s Court, the Supreme People’s Procuratorate, the Ministry of Public Security, and the Ministry of Justice jointly issued the “Opinions on Handling Criminal Cases of Dangerous Driving under the Influence,” introducing significant adjustments to its judicial application. Evidently, targeted research on this crime not only facilitates legislative amendments and judicial application to ensure better legal implementation, but also extends its academic value to broader discussions on the overall trend and methodologies of criminalization in China.

As the first specialized monograph on this topic published following the issuance of the 2023 “Opinions,” the book is structured around fifteen distinct topics, examining the crime from theoretical, legislative, judicial, and case-study perspectives. Spanning 470,000 words, the publication of this book is poised to promote the in-depth development of research on the crime of dangerous driving under the influence in China.
