Invitation to the 9th Youth Comparative Law Forum: Convergence and Divergence of Law (2023)

INVITATION

 

Dear experts:

In the domain of comparative law studies, the interplay between legal distinctions and shared traits, or the diversity versus unity of legal systems, has consistently been a pivotal subject of inquiry. Historically, there has been an enduring quest for legal convergence, yet the elimination of legal divergence has proven to be an elusive goal. Whether it was the medieval European concept of jus commune or the aspiration for a "common law of civilized nations" espoused at the 1900 Paris Congress of Comparative Law, these are fundamental manifestations of the drive towards legal harmonization. According to the American legal scholar Duncan Kennedy, there have been three waves of globalization in law and legal thought since the 19th century, which have fostered an almost illusionary concept of a universal legal code for humanity. Following the conclusion of the Cold War, the phenomenon of legal globalization surged, with China progressively embracing this trend through its policies of reform and opening-up, particularly around the time of its accession to the WTO, and engaging in extensive legal transplantation. However, since the dawn of the 21st century, the rise of anti-globalization sentiment and nationalist currents have brought the variegation, distinctions, and divergences among national legal systems to the forefront of comparative law discourse. Even Western countries, traditionally the principal exporters of universal legal norms, have reasserted the significance of legal differences through nationalist movements. Additionally, there has been a renewal of interest in the study of legal convergences and divergences, with legal anthropology, once a closely allied field to comparative law, experiencing a renaissance and becoming an integral component of the contemporary comparative law research agenda.

In order to harness the intellectual prowess of young comparative law scholars, to advance and innovate the field of comparative law within our nation, and to examine the commonalities and disparities between the legal frameworks of various countries, civilizations, and legal systems through historical, social, political, economic, and philosophical lenses, the Comparative Law Research Association of the Chinese Law Society is dedicated to fostering a deeper understanding and application of comparative law within the context of building a community with a shared future for mankind. We aim to explore novel dimensions in the relationship between legal uniformity and diversity, as well as between legal identity and difference. To this end, we are pleased to announce the 9th "Youth Comparative Law Forum" (2023), scheduled for December 3, 2023. The theme of this conference is "Convergence and Divergence of Law."

 

 

 

 

This conference is hosted by the Comparative Law Research Institute of the Chinese Law Society and co-organized by the Law School of Beijing Normal University and the Research Center for Rule of Law Development of Beijing Normal University at Zhuhai. The conference topics include but are not limited to the following aspects:

1. Various philosophical, historical and cultural studies and social science studies on the relationship between legal differences and commonalities.

2. Research on various perspectives on legal transplantation and legal globalization

3. Various studies on legal pluralism

4. Research on the relationship between legal anthropology and comparative law

5. Comparative study of Chinese and Western law and legal culture

6. Research on legal convergence and divergence in the information age

7. Research on future law and future rule of law

8. Comparative law research on other related topics

 

We warmly invite experts and scholars with a keen interest in the conference's theme and a distinct research profile in the field to join us at this annual gathering. Attendees are responsible for their own travel and lodging expenses, while the conference organizer will cover all other costs. The event is provisionally set to take place before November 12th. Authors of selected papers will receive formal invitation letters from the forum. We will promptly provide information on accommodation details, the conference agenda, attendance confirmation, and other relevant matters. This year's conference will be hosted outside of Beijing and Shanghai, at Beijing Normal University at Zhuhai, 18 Jinfeng Road, Tangjia Wan, Xiangzhou District, Zhuhai City, Guangdong Province.
