The 58th Lecture of the BNU Legal Practice Lecture Series Titled "Analysis of Securities Crime Trends and Judicial Practice" Was Successfully Held

On March 24th, the 58th lecture of the BNU Legal Practice Lecture Series titled "Analysis of Securities Crime Trends and Judicial Practice" was successfully held in the lecture hall of the Electronic Building of Beijing Normal University. The lecture was delivered by Liu Jing, a member of the Procuratorate Committee of the Third Branch of the Beijing Municipal People’s Procuratorate and the Director of the Seventh Procuratorate Department. The event was moderated by Shang Haowen, Associate Professor and doctoral Supervisor from the Law School of Beijing Normal University. The lecture drew over 130 faculty members and students.



This lecture is an important part of the course "Procuratorial Practice". To further implement Xi Jinping's thought on the rule of law, promote a positive interaction between legal education and prosecutorial practice, jointly implement the strategies of revitalizing the country through science and education and strengthening the nation through talent in the new era, and advance the cultivation of high-quality legal talents, the Law School of Beijing Normal University has launched a "Prosecutorial Practice" course in the spring of 2024, which will be lectured by experts with practical experience from the prosecutorial system. The course of "Procuratorial Practice" is based on the actual situation of prosecutorial work, focusing on the latest fields and achievements of prosecutorial reform, teaching students new concepts and practices of prosecutorial work in the new era, and laying a professional development foundation for law students who are interested in engaging in prosecutorial work and other judicial practices.

Prosecutor Liu Jing has been engaged in the review of criminal cases for 22 years, accumulating rich experience in handling cases in the fields of financial crimes, intellectual property infringement crimes, and duty-related crimes. He has been awarded honors such as "Top Ten Public Prosecutors" in Beijing, selected as one of the "Top 100 Young Legal Talents" in Beijing, and employed as a prosecutor instructor at the National Prosecutors College of P.R.C.

In the lecture section, Prosecutor Liu Jing first introduced the development status of China's securities and futures market to the students from the aspects of securities market structure, capital market formation, information disclosure system, and registration system reform. He also explained the overall situation and criminal regulation of securities and futures crimes in China from the perspectives of common types of securities crimes in judicial practice, execution chain mechanism, the function of procuratorial organs in managing securities and futures crime cases, and trend analysis of crime development. Next, Prosecutor Liu Jing elaborated on the main judicial practice issues in securities crimes, taking the crimes of insider trading, leaking insider information, trading with undisclosed information, and fraudulent issuance of securities as examples, from the perspective of explaining the constituent elements and analyzing the standards for handling cases. Regarding the controversial issues commonly encountered in judicial practice such as "abnormal transaction determination", "passive knowledge determination", and "degree of proof of contact", Prosecutor Liu Jing used typical cases publicly released through channels such as criminal trial references and joint publications by the China Securities Regulatory Commission, the Supreme People's Court, the Supreme People's Procuratorate, and the Ministry of Finance to provide a detailed interpretation of the main points of the judgment from the perspective of criminal law theory and practice determination, clarifying the practices and legal basis of the procuratorial organs in handling controversial issues.



Following the lecture, Associate Professor Shang Haowen offered insightful reflections, noting the specialized and interdisciplinary nature of securities crime research. He expressed his hope that students would leverage their diverse educational backgrounds to make significant contributions to both the academic study and practical application of securities law. This was followed by a lively Q&A session where students eagerly directed their queries to Prosecutor Liu Jing, seeking clarity on points of confusion. Prosecutor Liu Jing responded with thoughtful and detailed explanations. Concluding the event, Associate Professor Shang Haowen, along with the students in attendance, extended thanks to Prosecutor Liu Jing. The lecture concluded to the sound of appreciative applause, marking a successful and enriching experience for all.
