The 113th Session of the BNU Distinguished Jurist Lecture Series Titled “On the Separation of Trial and Execution” Was Successfully Held

The 113th session of the BNU Distinguished Jurist Lecture Series, titled "On the Separation of Trial and Execution," was successfully held in Room 1822 of the Rear Main Building. The lecture was delivered by the renowned civil procedural law expert, Professor Zhang Weiping, a Distinguished Professor at Yantai University's Yellow Sea Scholar Program, a professor and doctoral supervisor at Tsinghua University. Associate Professor Guo Xiang, Director of the Procedural Law Teaching and Research Center of the Law School of Beijing Normal University, served as the moderator. Dean Liang Yingxiu of the Law School of Beijing Normal University attended the lecture and participated in the discussion. Professor Xiong Yuemin also joined the discussion, and more than 50 teachers and students from the Law School of Beijing Normal University, including Associate Professor Li Xiaoxiao, attended the lecture.





At the beginning of the lecture, Associate Professor Guo Xiang extended a warm welcome to Professor Zhang Weiping and provided a brief introduction to his academic accomplishments.

The lecture primarily focused on the essence and approach of the separation of trial and execution. Professor Zhang Weiping started by introducing the background of this separation, explaining that the current legal norms are relatively rudimentary, and the draft of the Civil Enforcement Law is formed under the premise of internal separation, yet there is still room for discussion on external separation. He then discussed the significance of separating trial from execution. This separation refers to the division between the power of adjudication and the power of execution, specifically in their exercise. The exercise of adjudicative and executive powers follows different principles and norms, and they target different subjects and objects. The separation of trial and execution aids in the efficient and low-cost realization of rights that have already been determined. Finally, addressing the question of whether the separation should be external or internal, Professor Zhang Weiping opined that China should make an institutional choice based on the principle of maintaining the stability of the legal system and in line with judicial traditions.





During the discussion session, Professor Xiong Yuemin contended that Professor Zhang Weiping's perspectives provided a theoretical foundation for the separation of trial and execution in our country. Professor Liang Yingxiu engaged in an in-depth discussion with Professor Zhang Weiping on whether the separation of trial and execution could fundamentally address the challenges of difficult and chaotic enforcement.





Through this lecture, the students gained a more accurate and fresh understanding of the essence and approach of the separation of trial and execution. The lecture concluded successfully amidst resounding applause!
