The Twenty-second Legal School of Beijing Normal University—The lecture on "Legislation and Practice of Cultural Heritage Protection" was successfully held online at 19:00 on October 28, 2021. The lecture was given by Gao Xiaolong, a research librarian of Beijing Cultural Relics Bureau, together with Yu Chen, director of Beijing Heda Law Firm, and Peng Lei, researcher of China Cultural Relics Information Consulting Center. The lecture was presided over by Professor Chai Rong, Associate Dean of Law School. More than 100 students from Law School and other departments participated in listening and learning.
At the beginning of the lecture, Mr. Chai Rong introduced all the guests to the students, and then invited Mr. Gao to give a thematic lecture. Teacher Gao Xiaolong gave a brief introduction to the main contents of this lecture, which aroused students' strong interest in the protection of cultural relics.
First of all, Mr. Gao Xiaolong discussed the uniqueness and importance of cultural relics in a simple way. Cultural relics carry splendid civilization, inherit history and culture, and maintain national spirit. They are the "golden business card" of the country, the physical witness of the long history and endless life of Chinese civilization, the historical root of inheriting and carrying forward Chinese excellent traditional culture, the profound nourishment of strengthening the construction of socialist spiritual civilization, and the advantageous resources of promoting economic and social development. "If workers want to do a good job, they must sharpen their tools first", and legal norms play an irreplaceable role in the protection of cultural relics. The construction of the rule of law, which takes the cultural heritage left by ancestors as the object, is a cause that will benefit the present and benefit the future. The purpose of cultural heritage protection and inheritance is to regain human confidence and build unity, promote the sustainable and healthy development of human society, protect the diversity of global natural culture, and preserve human memory for inheritance.
Secondly, Mr. Gao Xiaolong told everyone about the basic concepts of cultural relics protection. The concept of "cultural heritage" was put forward in the Convention for the Protection of World Cultural and Natural Heritage, which was adopted by the General Conference of the United Nations Educational, Scientific and Cultural Organization at its 17th session held from October 17 to November 21, 1972. Teacher Gao showed us photos of the Great Wall as a UNESCO World Heritage List, which aroused students' interest and concern. Then, Mr. Gao talked about the main differences between "material cultural heritage" and "intangible cultural heritage" in theory and practice, and introduced in detail the International Convention for the Protection of Intangible Cultural Heritage adopted at the 32nd session of UNESCO in Paris. Finally, Mr. Gao showed his classmates many famous cultural heritages in China. The design pattern of village planning can also be the object protected by the relevant laws and regulations of cultural relics protection. For example, Shuiyuzui Village, Fangshan District, Beijing, has a high historical and cultural value because its layout design is compatible with the Book of Changes.
Then, Mr. Gao gave a detailed introduction to the current legal norms concerning the protection of cultural relics in China. China's cultural relics protection laws and regulations have been continuously improved, and a relatively comprehensive and complete system has been formed.
Finally, Mr. Gao described the specific development of cultural relics protection in recent years and the implementation of laws and regulations on cultural relics protection. Teacher Gao quoted Han Feizi: T The country will not be prosperous forever, nor will it be weak for a long time. If those who enforce the statutes are determined, the country will be rich and strong; If those who enforce the statutes are weak, the country will be weak. It is considered that to improve the legal norms of cultural relics protection, it is necessary to understand the practical application of cultural relics protection laws and regulations. At present, the workload of cultural relics protection is increasing day by day in our practice, while the reserve of relevant personnel is insufficient, and the implementation of legal norms is difficult. The implementation of some legal norms lacks supervision, supervision and accountability; Civil servants in cultural relics administrative departments at all levels do not have a deep understanding of cultural relics laws and regulations, which inevitably leads to deviations in their work; There are some problems, such as insufficient legal training for the use and management units of cultural relics, and the legal concept of the use and management units needs to be improved. Teacher Gao pointed out that "whoever started the trouble should end it", and called for strengthening research on issues related to cultural relics protection, and revising and perfecting laws and regulations to better cope with the current predicament.
Then enter the talk session. Teacher Yu Chen said that cultural relics are an objective carrier to distinguish between nations and nations, and they also play an important role in the future development of nations and nations. It is necessary to give full play to the role of relevant institutions of the People's Congress in the protection of cultural relics, further improve legislation, and enhance people's awareness of participating in the protection of cultural relics, so as to alleviate the current practical difficulties.
Teacher Peng Lei pointed out that there was a certain "vacuum" in the system of cultural relics protection, and the shortage of personnel in local cultural relics departments caused the cultural relics protection work to be in trouble, which was not conducive to the development of cultural relics protection work. Teacher Peng Lei called for strengthening the focus on the protection of cultural relics, narrowing the gap of legal researchers on cultural relics protection, perfecting laws and regulations related to cultural relics protection, and building a socialist modern legal system for cultural relics protection.
Finally, teachers and students had a heated discussion on specific issues of cultural relics protection, and the students benefited a lot. So far, this lecture has come to a successful conclusion.
